Please read these terms carefully before using our services or placing pre-orders.
These Terms of Service ("Terms") govern your use of Gestura LLC's ("we," "us," "our") website (gestura.ai), mobile applications, the Haptic Harmony Ring, and related services ("Services"). By using our Services, you agree to these Terms. If you disagree, do not use our Services.

1. Use of Services
You may use the Services for personal, non-commercial purposes, subject to these Terms. You must provide accurate information and comply with all laws. Prohibited activities include: unauthorized access, data mining, interfering with functionality, or using for illegal purposes. We reserve the right to suspend or terminate access at our discretion, without liability.
The Services may include open-source software under MIT license, hosted on gestura.app, for community-driven integrations (e.g., voice assistants). You agree to abide by license terms for any contributions or use.
2. Accounts and Security
To access certain features (e.g., pre-orders, forums), you may need an account. You are responsible for maintaining confidentiality and all activities under your account. Notify us immediately of unauthorized use.
3. Pre-Orders and Contributions
Important: Pre-orders are contributions to support Gestura's product development, in exchange for the opportunity to receive the product as an early adopter reward, subject to availability and production success.
This is not a guaranteed sale; risks include delays, modifications, or non-fulfillment due to supply chain, regulatory, or other issues. We may alter specifications or timelines without liability, with notice provided.
Payments via Stripe include product amount, taxes, and shipping (calculated at checkout). You authorize charges at pre-order time. Contributions are non-refundable except as below.
4. Shipping, Delivery, and Fulfillment
Estimated delivery: 3-4 quarters from pre-order (e.g., Q2-Q3 2026 for Basic model), not guaranteed. We provide email updates on delays. Shipping via standard carriers; you pay duties if applicable. Title/risk passes on shipment.
If delayed beyond 30 days from estimate, we notify you per FTC rules, offering consent to delay or full refund. Non-response within 30 days implies consent. If unfulfillable (e.g., production failure), we refund fully; this is your sole remedy. We are not liable for non-delivery or modifications.
5. Cancellations and Refunds

6. Intellectual Property
Services and products contain our IP. You grant us license to feedback. Open-source elements (e.g., gestura.app software) under MIT; comply with licenses.
7. Privacy
Data handled per Privacy Policy. We collect minimal info for Services/pre-orders.
8. Warranties and Liability
Disclaimer: Services/products "as is," no warranties (express/implied, including merchantability). Liability limited to pre-order amount; no indirect/consequential damages. Force majeure excuses performance.
9. Governing Law
California law; disputes in San Francisco courts. No class actions.
